1) Our Standard: Pride, Accuracy, and Full Transparency

We take pride in what we bring to market. Our intention is to only offer items we would be comfortable bringing into our own home. If an item doesn't meet that standard, it won't be listed.

We work hard to exceed customer expectations and to represent each lot as accurately as possible. Damage is never concealed in our images, and condition is never misrepresented.

We refuse items that are in unacceptable condition. We will never sell anything with undisclosed defects or offensive odors. If something is material to an item's condition, our goal is simple: you should be able to see it in the photos, read it in the description, or we won't offer it.

To highlight the items we sell, images may have the background removed. Other than background removal, we do not alter photos.

2) Accounts, Registration & Login Rules

Registration

All bidders must provide a valid credit card when registering. The card is used to authenticate bidders and to settle winning invoices unless other payment arrangements are made in advance (see Payment).

  • Usernames and passwords cannot contain spaces.
  • Account note: Do not use your email address as your username. Your username is publicly visible on the site.

3) Bidding Agreement (A Bid Is a Contract)

Placing a bid is a legally binding commitment. Bids are not placeholders.

By placing a bid, you agree to:

  • Pay for any lot(s) you win,
  • Follow the pickup, shipping, and delivery requirements, and
  • Allow MVES to enforce these Terms (including charging the card on file when applicable under these Terms).

No merchandise will be released, removed, or transferred until paid in full, unless MVES approves other arrangements in writing in advance.

4) Payment

Automatic Payment Capture

Unless other arrangements have been requested and approved in advance, MVES will automatically charge the card on file at 9:00 AM Mountain Time on the morning after the auction concludes.

Paying In Person or By Other Methods (By Request)

Although a card is required to register, you may request an alternate payment method in advance. If approved for your invoice, we will not automatically charge your card — provided payment is completed within the stated payment window.

Titled Items

Our payment processor prohibits credit card transactions on titled items including vehicles, trailers, and similar goods. Credit cards are not accepted on titled items. Payment for titled items must be made by cash, cashier's check, ACH transfer, wire transfer, or business or personal check (subject to approval).

Payment Not Settled

If payment is not successfully completed (declined card or missed approved in-person payment), the invoice is not settled. MVES may cancel the sale and re-offer the items if payment is not resolved promptly. Your account and bidding privileges will be suspended.

Payment Methods, Buyer's Premium & Tax

We accept ACH, wire transfers, cashier's checks, cash, debit cards, and credit cards. Business and personal checks are subject to approval.

A 10% buyer's premium is added to each invoice. New Mexico Gross Receipts Tax is added to invoices as required by state law. Applicable amounts are itemized on every invoice.

5) Auction Closing (Posted End Time + Soft Close)

Posted ending time: Each lot shows its own posted ending time. Lots close in sequence at a pace of one (1) item every two (2) minutes.

Soft close: If a bid is placed within the last two (2) minutes of a lot's scheduled closing time, that lot will extend by two (2) additional minutes. This continues until no further bids are placed within the final two-minute window. Soft-close extensions can continue indefinitely as long as new bids arrive within each two-minute window.

7) Pickup, Loading, Shipping & Delivery

Your invoice provides the pickup address, pickup window, and instructions. Our facility is located off Lohman Avenue in Las Cruces, New Mexico; the exact street address is disclosed to winning bidders on their invoice.

Frequent buyer note: If you're bundling wins across multiple auctions (especially small objects), contact us in advance — we can often coordinate a consolidated pickup plan when paid invoices and capacity allow.

Pickup (Appointment-Based)

Pickup is appointment-based curbside pickup during the published pickup period. If you can't make the pickup window, contact us in advance — when feasible, we can help coordinate an alternative plan (authorized agent pickup, delivery coordination, or eligible in-house shipping for non-fragile items).

Loading

We load items at pickup. Exceptions are rare and are disclosed in the description of the affected lot, typically for unusually heavy or oversized items requiring special handling. We reserve the right to refuse unsafe loading requests.

Shipping & Local Delivery

Some non-fragile items may be shipped in-house on a case-by-case basis.

For items we do not ship in-house, MVES will deliver them at no charge to UPS, FedEx, or another shipping vendor in Las Cruces of the buyer's choice; the shipping vendor will contact the buyer to coordinate packing, pricing, and delivery directly.

Local delivery may be available through independent third-party agents; see the Help page for current contacts. Arrangements, pricing, scheduling, and any liability for delivery service are between the buyer and the agent directly.

8) Holding, Storage & Offsite Transfer (Paid, Uncollected Items)

Applies to paid/settled invoices only. If payment is not settled, the sale may be canceled and items may be re-offered.

  • Days 0–14: Complimentary holding (no storage fees).
  • Day 15 and beyond: Onsite storage may apply at $10 per invoice, per day.
  • After Day 21: Items may be transferred offsite (see details below) to keep operations safe, secure, and on schedule.
  • After Day 28: If items remain uncollected and we do not have an approved pickup plan on file, items may be considered abandoned and forfeited.
Storage & offsite transfer fees (details)

How fees are calculated: Fees below are applied per invoice (not per item). This keeps things simple when an invoice includes a mix of lots.

Onsite storage (may apply)

  • $10 per invoice, per day beginning on Day 15 (after complimentary holding ends).

Offsite transfer (may occur after Day 21)

Offsite transfer may occur after Day 21 to keep operations safe, secure, and on schedule. When feasible, we provide a 48-hour courtesy notice by email to the address on file before transfer.

Invoice types (for transfer fee purposes): MVES determines invoice type based on size, handling requirements, and operational needs.

  • Small-Objects Invoice: contains only small, hand-carry items (no furniture / large objects).
  • Large/Mixed Invoice: contains any furniture/large objects and/or volume requiring special handling.

When offsite daily storage begins: Offsite storage begins on the date of transfer and accrues daily until items are collected or forfeited.

Offsite pickup: Once transferred offsite, loading assistance may not be available.

Day 28 forfeiture: If items remain uncollected beyond Day 28 and we do not have an approved pickup plan on file, MVES may, at its discretion, cancel the sale and dispose of the property by resale, donation, or other means. Amounts paid for forfeited items are not refunded.

High-touch note: If you're bundling purchases across multiple auctions, contact us in advance — when feasible, we can document an approved pickup plan to keep your items together.

9) Inspection & Condition

You're welcome to inspect your items at pickup. Once you leave the property with your items, they are yours and all sales are final.

Powered or electronic items may be tested for basic function when practical, but not every feature of every item is tested. Each lot is represented as described to the best of our ability based on access, time, and the nature of estate merchandise.

Auction items are sold AS-IS, with no warranties expressed or implied, unless otherwise stated in writing.

10) Use of Site / Technical Issues

The auction is conducted electronically and relies on hardware and software that may malfunction without warning. MVES does not guarantee uninterrupted or error-free service.

MVES may void a sale, temporarily suspend bidding, or re-sell item(s) affected by a malfunction. The decision of MVES is final.

11) Liability & Indemnification

Buyer agrees to indemnify and hold harmless MVES, its owners, employees, affiliates, clients, consignors, and associates from claims, damages, losses, or expenses arising from the purchase, pickup, loading, transport, delivery, or use of items, except where prohibited by law.

12) Right to Refuse Service / Policy Updates

MVES reserves the right to refuse service, suspend or revoke accounts, and enforce these Terms at its discretion.

MVES may update these Terms. Material changes will be posted on this page with an updated "Last updated" date. Continued use of the site or participation in an auction after a change constitutes acceptance of the updated Terms. The version in effect at the time of bidding governs that transaction.
